審判期日，被告或自訴人無代理人、辯護人到庭者，應由檢察官或他造當事人之代理人、辯護人陳述後，即行判決。 一、因基於確定之事實或依法得斟酌之事實，不適用法規或適用不當廢棄原判決，而事件已可依該事實為裁判者。 上訴狀內未表明上訴理由者，上訴人應於提起上訴後二十日內，提出理由書於原第二審法院；未提出者，毋庸命其補正，由原第二審法院以裁定駁回之。
上訴人之配偶、三親等內之血親、二親等內之姻親，或上訴人為法人、中央或地方機關時，其所屬專任人員具有律師資格並經法院認為適當者，亦得為第三審訴訟代理人。 訴訟標的對於共同訴訟之各人必須合一確定者，其中一人或數人於提起上訴後撤回上訴時，法院應即通知視為已提起上訴之共同訴訟人，命其於十日內表示是否撤回，逾期未為表示者，視為亦撤回上訴。 第一審之訴訟程序有重大之瑕疵者，第二審法院得廢棄原判決，而將該事件發回原法院。 前條判決前之裁判，牽涉該判決者，並受第二審法院之審判。
國防部最高軍事法院檢察長對於最高軍事法院及其下級法院之確定判決，亦得向最高法院提起之。 對於由最高法院或高等法院審理之軍事審判確定判決則應提請檢察總長為之。
3執行前項任務時，得依法搜索扣押被取締者之會計帳簿及文件，並得拆除其標誌等設施或為其他必要之處置。 銀行法第5-1條本法稱收受存款，謂向不特定多數人收受款項或吸收資金，並約定返還本金或給付相當或高於本金之行為。 銀行法第29-1條以借款、收受投資、使加入為股東或其他名義，向多數人或不特定之人收受款項或吸收資金，而約定或給付與本金顯不相當之紅利、利息、股息或其他報酬者，以收受存款論。
