判決書內應記載之理由，如第二審關於攻擊或防禦方法之意見及法律上之意見與第一審判決相同者，得引用之；如有不同者，應另行記載。 理由必須說明，原判決哪個部分違背法令，或是違背法律的原則，不能單獨只對事實爭執。
監察院接受人民陳情案件中，被告原經第一審法院判決無罪，由於檢察官收受判決時點之爭議，上訴改判被告有罪，造成程序上之突襲，亦屬多有。 再上訴期間為法定不變期間，檢察官收受判決書送達之時點，攸關其上訴期間之起算，影響訴訟當事人之權益，並關係案件之是否確定，應從法律制度面嚴格規範並落實對檢察官送達之規定，不容有絲毫爭議及解釋空間。 檢察官收受判決書送達之時點認定，迭生爭議，侵害人民訴訟權益，至為顯著。 一、原告對於一審判決敗訴部分，可以提起上訴，於上訴期間也可以追加或變更請求的範圍。

書狀可以自己手寫或打字，也可以到司法院的網站下載，或到法院的訴訟輔導科購買「刑事聲明上訴狀」的範本，由訴訟輔導科人員協助填寫並提出。 第三審法院認為上訴有第三百八十四條之情形者，應以判決駁回之；其以逾第三百八十二條第一項所定期間，而於第三審法院未判決前，仍未提出上訴理由書狀者亦同。 第三百六十七條之判決及對於原審諭知管轄錯誤、免訴或不受理之判決上訴時，第二審法院認其為無理由而駁回上訴，或認為有理由而發回該案件之判決，得不經言詞辯論為之。
