As a nonresident alien - you are generally taxed ONLY on income from US sources. If any of your wages are exempt from income tax under a tax treaty, you should receive a Form 1042-S rather than a W-2 form. Record your taxable wages on page one of Form 1040NR or Form 1040NR-EZ on the line for wages. Nonresident aliens are generally subject to tax on wages for services performed in the United States as effectively connected income. The general rules on personal service income are in Chapter Two of IRSPublication 519. Effectively connected income can also be partially or fully excluded from your income by treaty provisions between the United States and your home country.

Most active traders don’t generate significant dividend income paid by U.S. companies, so tax withholding is not a problem. Many of them get a foreign tax credit for U.S. tax withholding in their resident country. To make this renewal effort easier and reduce paperwork, the IRS offers a family option for ITIN renewal. If any individual receives a renewal letter from the IRS, they can choose to renew the ITINs of all of their family members at the same time rather than doing them separately over several years. Family members include the tax filer, the spouse and any dependents claimed on their tax return.

If you receive wages subject to US tax withholding, the due date for filing your tax return is generally April 15 of the following year. IWTA If April 15 falls on a weekend, the due date is the next work day that is not a holiday. If you did not receive taxable wages during the year, the due date for filing your tax return is June 15 of the following year, with the same deferral for weekends. Therefore, as a general rule, those individuals who qualify as a US resident, under either the green card test or the substantial presence test, are not eligible for treaty benefits. Also, note that an LLC may elect to be taxed as a corporation. In many cases, American taxpayers will also be required to pay self-employment tax in addition to income tax. As mentioned earlier, the IRS does not treat an LLC as a separate tax entity.

Foreign Source.If you receive a grant from a foreign payer, it is considered foreign source income and is not taxable. Generally, the source of a scholarship or fellowship grant is the source of the payer, regardless of who actually disburses the funds. Foreign source payments should not be reported on your tax return. If you received taxable wages during the year, you should receive a Form W-2 from your employer within 30 days after the end of the year.

For example, many foreign-owned Multi-Member LLCs also need to file Form 8804 and Form 8805. You will need to speak with an accountant to determine all of your U.S. tax filing requirements. The reason why is because Multi-Member LLCs taxed as a Partnership are considered Domestic Partnerships by the IRS, and Domestic Partnerships are U.S. persons, which must file a U.S. tax return.

One requirement for an S corporation is that it cannot have a nonresident alien as a shareholder (Sec. 1361). Nonresident aliens receive a $60,000 exemption from U.S. estate tax, which is equivalent to a $13,000 unified credit. Unlike U.S. citizens and resident aliens, this unified credit may not be used to offset U.S. gift tax. The unified credit allowed to nonresidents may be applied against estate tax only.
