Ijtihad dipandang sebagai sumber hukum Islam yang ketiga setelah Al-Quran dan hadis, serta turut memegang fungsi penting dalam penetapan hukum Islam. Telah banyak contoh hukum yang dirumuskan dari hasil ijtihad ini. Orang yang melakukan ijtihad disebut mujtahid.
Adapun sandaran ijtihad dari hadist adalah ucapan Nabi: “Apabila seseorang berijtihad dan dia benar maka baginya dua pahala, dan apabila dia salah maka baginya satu pahala.”
Fungsi ijtihad
Fungsi ijtihad adalah untuk mendapatkan solusi hukum jika ada suatu masalah yang harus diterapkan hukumnya, tetapi tidak dijumpai dalam
Al-Quran maupun hadis. Jadi, jika dilihat dari fungsi ijtihad tersebut, maka ijtihad mendapatkan kedudukan dan legalitas dalam Islam. Meskipun demikian, ijtihad tidak bisa dilakukan oleh setiap orang, tetapi hanya orang yang memenuhi syarat yang boleh berijtihad. Orang yang berijtihad harus
