1. Project information: Promoter and Substantive Body. Object and justification. Location. Synthetic description. Alternatives.-The promoter of the project is the hydroelectric company La Treita, S.L. and the substantive organ is the Northern Hydrographic Confederation.
The existing hydroelectric exploitation since 1944, is located in the parish of Sexosmil, in the municipality of Meira, belonging to the province of Lugo, in the Autonomous Community of Galicia. The La Treita hydroelectric power plant currently has a concession of 840 l/s of water from the Eo River, limited by the maintenance of the ecological flows, expressed in m3/s, shown in the table below, in accordance with the Declaration of Environmental Effects formulated according to the agreement of 6 February 1997 of the Galician Environment Commission.

These ecological flows meet the established criteria for environmental restitution flows adopted by the Northern Hydrographic Confederation and defined in Regulation 21.2.12 of the Watershed Hydrological Plan Regulations. In the same way in the already cited Declaration of Environmental Effects, the operation of the plant is limited, and it must remain in place during the months of July, August and September.
Given the average flows of the Eo River and the characteristics of the electromechanical equipment available to the existing hydroelectric power plant, the promoter considers it possible to turbanize a greater flow and thus optimize the performance of the facilities, at times when the flow of the river permits. Therefore, the project aims to increase the flow of concession of the current hydroelectric power plant La Treita from the 840 l/s to the 3,840 l/s, using the existing electromechanical equipment and without performing any type of work. The La Treita Plant is operational and consists of the following elements:
The dam on the river Eo, is built in concrete, of slightly trapezoidal section, has 35 m of length and 2 m of height, is of curved plant of large radii. At its right foot is the entrance to the derivative channel, while the left has a scale of fish.
The scale of fish is of an artisan type or successive and parallel deposits, it has five vessels intercomed by landfills to divide the total leap of the dam into smaller ones, saveable by fish with intermediate decant areas. The derivative channel has a length of 106 m, with a rectangular section of 2.50 m of medium width and 2.20 m of medium limestone. The central building is rectangular, 640 × 5.20 m and 5.20 m high. The evacuation power line is 368 m long. The restitution channel consists of natural stones. The environmental impact study does not contemplate other alternatives, since existing infrastructures are to be used and that for the modification of the turbinable flow requested, it is not necessary to carry out any civil work.
2. Significant environmental elements of the project environment. The La Treita hydroelectric plant is located within Red Natura 2000, specifically in the LIC (ES ) "Río Eo", an area also declared as a Special Protection of Natural Values by Decree 72/2004 of 2 April, which integrates it into the Galician Network of Protected Spaces.
In the location area we find coastal formations, with specimens of alders (“Alnus glutinosa”), fresnos (“Fraxinus excelsior”), chopos (“Populus nigra”) and willows (“Salix sp.”). Regarding the fauna, in the river Eo stands out the presence of protected fish species such as the Atlantic salmon (“Salmo salar”) and the sábalo (“Alosa alosa”). In addition, the presence in the area of two protected molluscs, such as the "Margaritifera margaritifera" (Margaritifera) and the Quimper's snail (“Elona quimperiana”) is also relevant. It is also interesting to highlight among mammals to the otter (“Lutra lutra”) and the Iberian demise (“Galemys pyrenaicos”).
3. Summary of the evaluation process:
a. Pre-consultation phase and determination of the scope of the impact study. (a) Input of initial documentation. The process began on 31 January 2006, when the Ministry of the Environment has access to the General Directorate of Quality and Environmental Assessment the environmental documentation of the project "Modification characteristics of hydroelectric aporvechament in the Eo River in Sexosmil. (b) Previews. Relationship of consultation and answering.
The Directorate-General for Quality and Environmental Assessment, dated 1 August 2008, established a period of consultation with institutions and administrations foreseeably affected by the implementation of the project. The reference ratio is set out below:

The most relevant environmental aspects considered in the responses to the prior consultations are:
Sensitive areas and hydrology.- The hydroelectric use to modify is located within Red Natura 2000, specifically in the LIC (ES ) "Río Eo". In addition, the river Eo has been declared Natural Space in General Protection Regime and Special Protection Zone for Natural Values. According to reports from the Directorate General for Conservation of Nature of the Board of Galicia, there are no natural habitats of community interest in the location area.
The projected expansion can lead to a reduction in the flow rate through the river stretch between the catch point and the central one, an increase in the speed in the takeover of the canal and a higher flow in the restitution area, with the consequent increase in the "called" effect towards the restitution of the turbine. It is emphasized in the need that the operating regime of the central system remains of a flowing type. The establishment of an ecological flow suitable to the ecohydrological requirements of the river Eo is considered essential. In this regard, the Directorate General for Conservation of Nature of the Board of Galicia reports that the ecological flows currently established are sufficient for the maintenance of the river ecosystem in the affected section. The Northern Hydrogaphical Confederation reports that the proposed ecological flow regime complies with the provisions of the Cuenca Hydrological Plan, further states that in the absence of any projection of the execution of any civil work there should be no added environmental problems. Flora and fauna.-The increase in the volume of turbination flow can result in an alteration of the circulating flows in the river Eo, which would affect the existing coastal vegetation in the area of action. In relation to the fauna it is evident that in the area of action there are numerous protected species, highlighting among others the otter (“utra lutra”), the Iberian demman (“Galemys pyrenaicus”), the serrana lagartija (“Lacer monticola”), the verdant lagarto (“Lacerta schreiberi”), the sácolosa In the area of study, there are important areas of breeding and alloying of the Atlantic salmon, which is why there should be no interference in the migration cycle of the aforementioned salmonido. In relation to the river muperla, a survey should be carried out in the area affected by the central one and a detailed study of the possible conditions on the species in a section between the capture and the restitution and in a section below the restitution not less than 1,000 meters. Historic-artistic and cultural heritage.-The General Directorate of Cultural Heritage of the Council of Culture and Sport of the Board of Galicia, favorably informs the project, warning that in case of performing some kind of work outside the scope of the project, it would be necessary to obtain a new report of this General Directorate.
(c) Summary of indications given by the Environmental Body to the Promoter on the scope and detail of the environmental impact study, and on the affected environmental administrations.
The result of the responses to the consultations was referred to the promoter on February 6, 2007, including a copy of the responses received, and the most relevant aspects that the environmental impact study should consider.
b. Public information and consultations on the environmental impact study.
(a) Public information. Outcome. On 10 August 2007, it is published in the Official Gazette of Lugo Province, No. 184, the announcement that the project and environmental impact study of the request for modification and authorization of the hydroelectric use of hydroelectric power plant La Treita, S.L. are submitted jointly to public information.
The Northern Hydrographic Confederation certifies on 19 September 2007 that there have been no allegations in the period of public information.
(b) Consultations with affected environmental administrations. Outcome.
On 6 June 2007, the Northern Hydrographic Confederation, in its capacity as a substantive body of the project, consults the affected public administs, in application of articles 9.3 and 9.5 of the Royal Legislative Decree 1/2008 of 11 January, which approves the consolidated text of the Environmental Impact Assessment Act. These consultations are reiterated on 5 October 2007 to those administrations that have not yet issued a report.
In response to consultations on the environmental impact study, the following responses have been received:
The Directorate General of Cultural Heritage. Department of Culture and Sport. The Galician Board favorably informs the project presented, stating that in case of any action taken outside the scope of the project, it should be re-informed.
The Directorate General for Conservation of Nature.Consejería de Medio Ambiente y Desarrollo Sostenible.Junta de Galicia warns that in the environmental impact study some of the conditions that it raised during the period of prior consultations have not been taken into consideration. It considers it necessary that the final constructive project incorporate the following conditions:
Modification of the dimensions of the take, with the aim of reducing the approximation speed of the water in the take of the channel below 0.35 m/s.
Installing an effective interdiction device, of the type with separation between folds equal to the current one (1 cm), but tilted about 45o with respect to the bed and about 60o and with respect to the axis of the channel. Construction of a skeleton and a fish evacuation ramp attached to the canal wall, located next to the grid plane in the vertex resulting from the insertion of the grid plane with the side wall of the channel. This evacuation by-pass must be equipped with a flow of at least 150 l/s from the ecological flow to release at each time of the year. It will lead the fish to a safe area down the azud, unloading in a pox of at least 1 m deep. Maintenance of a sensitively constant level in the sugar. This level must be automatically consigned and maintained at all times. This means that the power station should always operate in a flowing manner. In order to reduce the "called" effect of the turbid water and to prevent the access of fish to the restitution channel, an interdiction device (of the type bars with separation between 2 cm plates) will also be installed, the energy dissipation elements must also be projected and the flow to the channel in a diffuse manner. He also stated that the final constructive project should be approved. The Environmental and Hydrological Studies Service. North Hydrographic Confederation dated 2 October 2007 issues written where it states that the flow expansion project can be authorized provided that the prescriptions imposed by Hydrological Planning and by the D.G. for Conservation of Nature of the Galician Board are met.
(c) Modifications introduced by the Promoter in project and study after consideration.
On 29 November 2007, the confrontation took place on the ground of the project, which was attended by representatives of the Northern Hydrographic Confederation and the La Treita Hydroelectric Company, S.L.
In the report of the confrontation of the project, dated 18 December 2007, the installations that form part of the jump and its main characteristics are recorded, verifying that the data of the project coincide on the ground and that the project already meets some of the conditions imposed by the D.G. of Conservation of Nature of the Council of Environment and Sustainable Development of the Board of Galicia, such as the speed of approximation of the water and of the operation of the central flowing. The rest of the modifications imposed will be incorporated into the final constructive project, which must be previously approved by the General Directorate.
4. Integration of the evaluation.
a. Significant impacts of the chosen alternative. The main environmental effects of the project, as well as the main preventive and corrective measures proposed in the environmental impact study, are summarized below: Sensitive areas, hydrology, flora and fauna.-With the development of the project, no civil works will be carried out. JBH News in the flow rates used in the La Terita hydroelectric plant can mean a decrease in the flow rate in a stretch of about 200 m from the Eo river, located between the take-off and the restitution work, which could affect the river ecosystem in general, and, in particular, the species of flora and fauna associated with it.
However, the promoter takes the necessary measures to reduce the condition on the hydrology of the river Eo, as well as on its associated flora and fauna, since it meets the ecological flows endorsed both the Directorate General for the Conservation of Nature of the Department of Environment and Sustainable Development of the Board of Galicia, and the Northern Hydrographic Confederation, which are detailed below (in m3/s):

The promoter is committed to maintaining at all times the minimum ecological flow regime. It is also described, that the center has a fully automated system with alarm equipment, which ensures the maintenance of the correct turbinable flow at all times. Also, the central station will remain standing during the months of July, August and September and will always operate in flowing mode and never with regulation, keeping the water passage above the sugar at all times.
In order to mitigate possible conditions to the ictiofauna, in addition to the aforementioned maintenance of the minimum ecological flows, the azud already has a scale of fish built on its left foot, which allows the passage of them and will always be maintained in good conditions of use. In addition, the hydroelectric power plant will remain at a time of increased influx of salmon sprains in descending migration, which is usually in the month of April, although the exact time will be determined by direct observation. These proposed measures will also limit the conditions to potential molluscs in the area of action. To avoid as much as possible the mortanity of terrestrial fauna, the promoter contemplates the disposition of artificial steps for small and medium-sized vertebrates on the channels of derivation and restitution. The vegetation of the river may be affected by the changes in water level in the river, although the promoter considers that these changes will be progressive, since the use regime adapts to the natural flows of the river Eo. Similarly, to mitigate damages, the existing vegetation in the field and in coastal areas, especially trees, will be respected, avoiding unnecessary deterioration.
5. Specific protection conditions. - The final constructive project, which incorporates the conditions imposed by the Directorate General for the Conservation of Nature of the Council for Environment and Sustainable Development of the Board of Galicia, already reflected in paragraph 3 (b) of this resolution, must be approved by the same governing body prior to the authorization of the project. The final timetable for the implementation of the project shall be authorized by the technicians of the aforementioned General Directorate.
6. Specifications for environmental monitoring.-The environmental impact study includes an environmental monitoring program for both the exploitation phase and the abandonment phase, which is considered appropriate, where requirements are established for the observation and monitoring of the different planned actions, as well as the correct implementation and compliance of the proposed preventive and corrective measures. It will be controlled that the projected actions will be developed according to the authorized project and that the potential impacts will be matched with those envisaged by the environmental impact study. In the event of identifying any unforeseen impact, the definition of new measures will be made to allow their minimization. The environmental monitoring programme includes the following measures during the exploitation phase:
Control over hydrology: control of the alteration of the channel and the quality of the waters of the river Eo. To this end, the revision of automated level measurement systems, the verification of the operation of alarm systems and the maintenance of the system of self-cleaning of the gate, to the restitution channel is planned.
Control over river fauna: control of habitat alteration and associated biodiversity. To this end, the maintenance and cleaning of the rebound scale is planned; the determination by visualization of the downward period of the salmon sguimes to stop the center; to review the correct state of the bars; to propose the stival stop plan of the central and to periodically review the regime of the established ecological flows.
The environmental monitoring programme includes the following measures during the drop-out phase:
Control of sound emissions. This will control the good condition of the machinery used, as well as the speed of displacement; the load and discharge operations and the vibrations produced.
Water flow control. For this purpose, contaminated water spills will be carried out in a controlled area. Atmospheric quality control. By reducing dust emissions.
The promoter must explain, in the posters announcing the works corresponding to the project evaluated, the BOE in which his Declaration of Environmental Impact is published. Conclusion: Accordingly, the General Secretariat for the Prevention of Pollution and Climate Change, in the light of the General Directorate of Quality and Environmental Assessment Resolution Proposal, dated 10 April 2008, made a declaration of environmental impact favourable to the realization of the project "Modification characteristics of hydroelectric use in the Eo River in Sexosmil. Central La Treita Plant. T.M.: Meira (Lugo)", concluding that, provided that the environment and natural resources are adequately protected when and when authorized in the above-mentioned alternative and conditions, which have been deducted from the assessment process.
What is made public and communicated to the substantive body for its incorporation into the procedure for the approval of the project, in accordance with article 12.1 of Royal Legislative Decree 1/2008 of 11 January, which approves the consolidated text of the Environmental Impact Assessment of Projects Act.
