How to Report Plagiarized NFTs as Stolen Art

You've been ripped off.



Someone took your art and, with your permission they created an un-fungible token. And now that same scammer has listed those NFTs of your plagiarized art for sale, and is raking in the undeserved gains. This is a tragic and regular situation. Fortunately, you have options. But, it's difficult to get your stolen artwork removed on major NFT exchanges such as OpenSea or Rarible.



Welcome to the other side of the much-hyped NFT coin, where fake works and plagiarized artwork dominate what in 2021 was a $44 billion market. The problem is so widespread that in January of 2022 the self-described "world's largest and first NFT marketplace," OpenSea, admitted that more than 80 percent of NFTs created using its free minting tool "were plagiarized works as well as fake collections and spam."



Artists are well-aware of the less glamorous side to NFTs. Twitter accounts that expose NFTs of stolen artwork (like @NFTtheft) have thousands of followers and draw attention to this scam.



A Bay Area artist goes by the name "bor" and runs the twitter account @NFTtheft. They said they prefer to remain anonymous because of the harassment directed at artists who are opposed to non-fungible tokens.



Bor said that plagiarism is an intractable issue in the NFT space and will always be a factor. "As long as anyone can mint anything while remaining pseudonymous on an unregulated/decentralized technology, plagiarism is going to be a big problem."



It's an issue that marketplaces where people list, buy and sell NFTs are aware of. The steps they take to mitigate it, however, often fail to meet the requirements. OpenSea and Rarible (a competitor to OpenSea) have established procedures for people who wish to report stolen work. However, as artists often point out it isn't always straightforward.



Many artists see it as their only alternative.



OpenSea: How do you report an allegedly stolen NFT



Visit OpenSea's Help Center.



Click on the "How can you assist?" drop-down menu. drop-down menu, select "Intellectual Property Rights Violation / Takedown Request."

Enter your email address.





In the subject line in the subject line, type "fraudulent content."





In the "Description" section In the "Description" section, give as much detail as you can to show that an OpenSea listing is just your artwork that you have posted without permission (include hyperlinks). Please explain the images you've attached (see Step 6 below).





Include screenshots under "Attachments" of both where your artwork actually is online (presumably someone copied it before posting it on OpenSea). Also include the NFT listings.





Hit "Submit."





OpenSea cannot guarantee any result or that the company will follow up with you.



"When you submit a request in the next step our team will go through the information to determine if it is in violation of our Terms of Service and will remove it if so," explains the company's Help Center. "Please keep in mind that following resolution your ticket will be closed and you might not hear back from us directly."



How do you report a stolen NFT on Rarible



Rarible like OpenSea has a reporting process that allows users to report stolen artworks on its marketplace as NFTs for sale. To report stolen artwork in the form of NFTs on Rarible:



Once you have located the NFT you are looking for, click the three dots in the upper-right corner.





Select the "Report" option.





Write that the work is stolen and provide as much detail as possible to support your claim.





Hit "Report."





Rarible can't promise that it will remove itself from the NFT. Artists' frustration is understandable as Rarible doesn't guarantee that it will respond to their concerns.



How do you stop plagiarized NFTs



Despite the ability of artists to report stolen NFTs directly to the marketplaces that list them, the issue of thieves profiting from the work of designers, illustrators and musicians as well as other creators isn't being solved. According to the artist behind @NFTtheft's Twitter account, the issue is systemic and requires an overall solution.



"Scammers are stealing from YouTube, Twitter, Instagram, Deviant Art, Artstation and even Minecraft fan forums," wrote bor. "If it's possible to download it, scammers will attempt to take it. Artists are less in control of their work than they ever had before."



Indeed, a quick glance at Twitter shows scores of shocked artists claiming that someone has taken their work, and, with no' knowledge, minted and sold it as NFTs.



What other actions can people who are unwittingly being sucked into this sometimes fraudulent environment take, other than notifying NFTs that are plagiarized? Non-fungible token true believers are not going to like the answer, if Bor is right.
