Responses to Summary Judgment Motions Filed in World Of Warcraft Glider Bot Lawsuit

Blizzard has filed responses to MDY's Motions For Summary Judgment in their lawsuit over the popular World of Warcraft automaton program "WoW Glider" ("now "MMO Glider") Exhibits include an expert report supporting MDY from Koleman Strumpf (PhD, Economics) of the University of Kansas School of Business.



The Strumpf report counters Edward Castronova's (PhD Economics, Ph.D.) expert report that was filed in Blizzard's motion to dismiss judgment last month. Strumpf concludes that there is no evidence that Glider is harmful to World of Warcraft, or Blizzard. He even suggests that Glider could be in the best interest of Blizzard by increasing the amount of time players play and subscribers. Blizzard, obviously, disagrees. Blizzard's response also deals with claims for copyright and contract, among others.

For the background of this case, read the entire VB coverage of MDY vs. Blizzard. Briefly, Glider is a program that users run along with World of Warcraft. It automatizes the key tasks of World of Warcraft, making it possible to play the game essentially unattended. Glider users can , therefore, gather resources and create high level characters without actually playing. MDY originally filed this lawsuit in federal court in Arizona seeking a declaratory judgement that MDY does not infringe Blizzard's intellectual rights by selling the Glider program. Blizzard responded by asserting copyright and trademark violation as well as a few business torts. The summary judgment stage is now completed. This is the stage where the judge will rule on issues which are sufficiently established that they do not have to go to a jury.



I usually post excerpts from such documents, but I'm on traveling this week and am unable to complete the task. Instead of failing or waiting a week before sharing the documents, I will publish them now and let readers browse out the exhibits and responses. I have read both the responses and can declare that they were both compelling and creative. These briefs are among the most compelling I've ever read, since I began writing about virtual and game world lawsuits. The exhibits contain a wealth of information, including deposition transcripts and forum posts.
