Namuwonge's claim is not time-barred because Kronos did not publish its data-retention policy. Similarly, the Court finds that Namuwonge failed to plead facts that placed Kronos within the BIPA's categories of biometric data collectors. Hence, the Court denies the motion to dismiss Count I. In sum, Namuwonge cannot claim damages for her notebook due to her allegedly misusing the case.
Namuwonge also claims that Kronos failed to maintain a satisfactory biometric data retention policy. Kronos' contentions are based on the premise that possession is necessary for an owner to recover damages. The BIPA was passed more than ten years ago, and the defendant has failed to implement it. As a result, the Court finds that the defendants' failure to provide a proper biometric data retention policy is sufficient for damages.

Compared to other hard cases, the Apple case offers a number of additional benefits. For one thing, it offers a wide colour selection - eight shades of blue and green, for example. It is also available with a transparent cover, which lets you see the Apple logo on the front. However, its lack of a cutout for the Apple logo is a downside.
