Τα ανθρώπινα δικαιώματα έχουν αποτελέσει αρκετές φορές αιτία κοινωνικών εξεγέρσεων, παρά το γεγονός όμως ότι έχουν δοθεί πολλές μάχες για να κατακτηθούν και να προστατευθούν, αυτά τα δικαιώματα, σήμερα ως πολίτες της Ένωσης τα θεωρούμε αυτονόητα και άλλες φορές δεν τα γνωρίζουμε και δεν τα ασκούμε επαρκώς. Ωστόσο, τα δικαιώματα αυτά, αποτελούν αναπόσπαστο μέρος των συνθηκών της Ένωσης ήδη από το 2000, όταν η ΕΕ εξέδωσε τον Χάρτη Θεμελιωδών Δικαιωμάτων, αλλά ενισχύθηκαν περισσότερο όταν ο Χάρτης έγινε νομικά δεσμευτικός με την Συνθήκη της Λισσαβόνας το 2009.
με τη Συνθήκη της Λισσαβώνας, άρθρο 20, παρ. 1, της ΣΛΕΕ, θεσπίζεται η Ιθαγένεια της Ένωσης και «Πολίτης της Ένωσης είναι κάθε πρόσωπο που έχει την υπηκοότητα ενός Κράτους – μέλους». Η ιθαγένεια της Ένωσης προστίθεται και δεν αντικαθιστά την εθνική ιθαγένεια. Στα άρθρα 21, 22, 23 και 24 της ΣΛΕΕ, αναλύονται διεξοδικά τα θεμελιώδη δικαιώματα του Ευρωπαίου Πολίτη. Ακόμη, σύμφωνα με τον Χάρτη Θεμελιωδών Δικαιωμάτων της ΕΕ προστατεύονται τα ανθρώπινα δικαιώματα, εν συνόλω. Επιπροσθέτως, το άρθρο 11, θέτει ένα στόχο ο οποίος αφορά στην εκπροσώπηση των πολιτών στα Ευρωπαϊκά Θεσμικά Όργανα.
