marbury was just refused his job by jefferson and he was standing on the fact that the judiciary act of 1789 had the writs of mandamus thing included (which said a court (in this case the Supreme Court) could order an inferior government official (in this case Marbury) to fulfill their position) but Marshall said that part was unconstitutional
