The SA police can effect the arrests: The Judge said, "It is clear from Anwa Dramat's letter that the offer (of taking early retirement) was made under duress. Dramat is disillusioned with the Police Minister Nhleko's inability to act lawfully and with his attempts to subvert his office and authority."

It was President Jacob Zuma who appointed Nhleko to act illegally. Additionally, the president acted unlawfully in his attmepts to subvert Dramat's office, power, and authority.

The Judge said that "the appointment of the third respondent Ntlemeza as Acting National Head depends for its validity on the suspension of Dramat and is, consequently, invalid as the legal foundation for such an appointment was non-existent."

Essentially, the decision to appoint Berning Ntlemeza as Acting National Head was dependent on the irrational suspension of the Head of DPCI Anwa Dramat which the court found to be unlawful, unconstitutional, invalid and set aside.

President Jacob Zuma under the SAPS Act 17CA would have been aware of the Directorate appointment. He was the one who gave approval for the invalid decision that is directly tied to the invalidated suspension. The SAPS Act 17CA, states, "The Minister with the concurrence [approval] of Cabinet [the president] shall appoint the National Head and the deputy National Head of the Directorate." But legally.

The arbitrary decision to have Dramat removed from his DPCI post and altogether his unit, coincides with Dramat's directive to have national priority cases and dockets in the country filed at various police stations to be brought and/or centralised for investigation at his head office in Silverton. One of the suspects is facing over 783 criminal charges including defeating the ends of justice. This was to be handled at national level.

The President and the Minister's conduct to interfere with Dramat, the Directorate is in direct violation of their oath of office, the SAPS Amendement Act 17E 9b, the Constitution and cited court rulings.

The SAPS Amendment Act Section 3 (5) and 20 (b) indicates that SAPS, DPCI, NPA, IPID and its partners by law have to work together. The Hawks police have to effect the arrests. The Judge said that the head of the Directorate Dramat was under duress.

The Makhanda case has to go before an officer and prosecutor who is competent, fit and proper with experience, skill, and integrity. Not to Ntlemeza who's in the Directorate - illegally.
