PARTICIPATION AGREEMENT, WAIVER, RELEASE AND ACKNOWLEDGMENT BOOSTERTHON FUNRUN
Booster Enterprises, Inc. ("Booster") has been engaged by ("School") to host and organize a fun run/walk, as well as other learning activities and pep rally type events (collectively, the "Events") to be held at the School {Pep Rally: , Fun Run: }.

I know that an organized walk/run, regardless of distance, can be a potentially hazardous activity regardless of the care taken to avoid injuries and/or illness, and that Participant, which is either myself and/or a child aged eighteen or under for whom I have legal guardianship, should not enter organized physical activities unless medically able and in proper health. I acknowledge that the Events may include other physical activity including walking, running, skipping, dancing, physical exercises, and jumping that may be potentially hazardous regardless of the care taken to avoid injuries and/or illness. I understand that I am solely responsible for Participant's health and safety in connection with the Events to be held at the School, and I acknowledge that Participant is physically capable of participating in and completing the Events.

In consideration for Booster's acceptance of my entry, I assume all risks associated with Participant participating in the Events including, but not limited to, personal injury and fatality, which may be caused by, without limitation, falls, contact with other participants, weather related conditions (including high heat and/or humidity), and other conditions at the site(s) of the Events, all such risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of your accepting Participant's entry, I, for myself, and for Participant, Participant's heirs, executors, administrators and anyone else entitled to act on Participant's behalf, to the full extent permitted by law, waive and release the organizers of the Events, Booster and all other sponsors, suppliers, agents and independent contractors of the Events, and each of their employees, officers, agents, volunteers, representatives and successors (collectively, "Booster's Representatives") from all claims, demands, actions, causes of action and liabilities of any kind arising out of Participant's participation in any of the Events. This release includes claims based on the negligence of any type whatsoever of Booster and Booster's Representatives, but expressly does not include claims based on their intentional misconduct or recklessness. I understand that by agreeing to the release and waiver herein, I am assuming full responsibility for any and all risk of injury, fatality, or property damage suffered by Participant while participating in any of the Events, and I am releasing claims and giving up substantial rights, including any right to sue.

I am eighteen years of age or older, and, if acting on behalf of a minor, have every right to contract for the minor in the above regard.

Should any portion of this Waiver, Release and Acknowledgement be judicially determined to be invalid, voidable or unenforceable, for any reason, such portion of this Waiver, Release and Acknowledgement shall be severable from the remaining portions hereof and the invalidity, voidability or unenforceability thereof shall not affect the validity, effect, enforceability or interpretation of the remaining provisions of this Waiver, Release and Acknowledgement.
