Bernhard Burgener vs David Degen is yet another step in the FC Basel owner dispute. The Board of Directors supports Burgener's plans. However, no agreement has been reached.
Monday's meeting of the Board of Directors at FC Basel Holding AG was a success. Burgener, Degen, Karl Odermatt, and Peter von Buren all approved the previous owner's plans. According to the statement of the holding company he asked Degen if he would sell his stake to Basel Dream & Vision AG.
To do this it is the Board of Directors relies on an agreement with the law firm which permits Burgener to sell its own shares to the shareholders of the minority shareholders in the same conditions. The drag-along option is considered to be superior to Degen's pre-sales right.
Burgener and his team have now made a move in this dispute with the ownership. https://www.hlee.ch/de/Bernhard-Burgener.htm wants to take advantage of his right of first refusal to 16.4 million Francs. Burgener's 80 percent stake in Basel Dream & Vision AG was restricted by a super-provisional order. The British asset manager Centricus could also own an interest in the company. Burgener will still hold the majority of the votes.
According to FC Basel Holding AG, Burgener (and Degen) are looking for an out-of-court settlement of the "interests of FCB"
