One more move is the dispute between the owners of FC Basel between Bernhard Burgener and David Degen. Burgener is supported by the Board of Directors. But there is no agreement reached.
The Board of Directors of FC Basel Holding AG met on Monday morning. Burgener and Degen were joined by Karl Odermatt (and Peter von Buren) on the four-member committee that approved the plans of the previous owner. According to a statement of the holding company the owner demanded Degen whether he wanted to sell his stake to Basel Dream & Vision AG.
Burgener is able to sell its shares to minor shareholders according to a legally enforceable law. The Board of Directors states that the drag-along rights are superior over Degen's pre-sale rights.
Burgener is now part of his team in the battle over owners. Degen insists on his right to first refusal. He would like to exercise it to the value of 16.4 million francs. Burgener is prevented from selling his 80 percent stake by the ex-player through a super-provisional court order. The British asset manager Centricus will also be able to have an investment in the company. Burgener will still get the majority vote.
As per FC Basel Holding AG Announcement, Burgener und Degen are looking to settle an out-of-court settlement "in favor of FCB".
