1 The Licensee shall use the said flat for residential purpose only of himself and his immediate family
and bonafide servants and the Licensee hereby convents not to use the said flat for any other
purpose, The Licensee shall not permit or allow any other third person to occupy or reside in the
said flat
2. The Licensors shall be deemed to be in possession of the said flat at all times and Licensee will be in
use and in occupation of the licensed flat as a mere licensee, it being the intention of the parties
hereto that the exclusive possession of the licensed premises shall vest with the Licensors alone.
3. Both the parties mutually agree that the Licensors shall be entitled to collect such amounts being
the amounts towards the damage, loss caused by the Licensee to the said flat and / or any furniture-
fixtures therein and the quantum shall be determined by the Licensors. The Licensors shall also be
entitled to retain such amount of deposit equal to the dues of electricity bills and other charges
which the Licensee is supposed to pay and are not paid by him in the due course.
4. The Licensee is satisfied and it is hereby agreed that he shall keep the interior of the said flat and the
floors, walls, ceilings, doors, windows, electricity installations, water taps, fans, tubes and other
fittings and fixtures thereof in good condition (reasonable wear and tear and damaged by fire and
tempest and acts of God expected) and both the parties specifically agree that Licensee shall repair,
make good or replace any damage on breakage caused (if any) to the same or any part thereof.
5. The Licensee agrees that Licensee shall not keep or store in or upon the said flat petrol or any other
goods of combustible / hazardous or explosive nature which are prohibited by law except goods of
such nature as are required for household use and car and permitted by the Law nor to do or suffer
to be done on the licensed flat anything which shall be objectionable for the safety of the said flat /
premises.
6. It is agreed between the parties if the Licensor or Licensee commits a breach of any of the
conditions mentioned in the agreement or in case of a need arises for the Licensors to have the
possession of the said flat, or any conditions of the agreement are not performed, The Licensors
shall be giving 30 days’ from the date of the notice to the Licensee to recover the possession of the
said flat. The Licensor also reserves the right to give 30 days notice of vacating of the said flat
without assigning any reason whatsoever. Notwithstanding anything contained to the contrary
herein and upon such termination The Licensor or his authorized representatives shall be at the
liberty to enter upon the said flat for the purpose to break open the doors, locks, windows etc to get
entry into the said flat and thereupon the Licensee and / or his family members and servants
occupying the said premises shall remove themselves with all their belongings from the said
premises and shall handover quiet, peaceful and vacant occupation of the said flat to the Licensor
and his representatives. It is distinctively agreed between the parties that such action taken by or on
behalf of Licensors to enter upon the said premises in the manner aforesaid shall be valid and lawful
and the Licensee shall not raise objection thereto or question the same in the court of law.
7. The Licensors shall not be responsible for any damage that may happen to the person or property
whatsoever of the Licensee and / or his family members, servants, visitors using the said flat for the
time being by fire, rain, floods, bursting of water, or electricity wires, castings or tubes or other
installations in or about the said premises or by giving way of any portion of the flooring, walls,
ceiling or any part of the building or any cause whatsoever that invites using the said flat.
8. Upon the termination of the License hereby created or sooner determination thereof, the Licensee
and his family members and servants shall forthwith remove themselves together with their
furniture, fixtures and belongings and shall handover quiet, vacant and peaceful possession of the
said flat. If the Licensee and family members and servants continue to occupy the licensed flat after
the termination and / or determination of the License hereby granted then and in such an event the
Licensee shall do as a trespasser and will be liable to ejectment proceedings. It is hereby agreed that
until the vacant occupation of the said flat is handed over to the Licensor as aforesaid the Licensee

shall be bound to and liable to pay to the Licensors a sum of Rs 750 per day by the way of agreed
compensation of the said flat.
9. The Licensors shall retain the original keys in respect of the said flat and the duplicate keys in
respect of the said flat shall be with the Licensee after execution of this agreement. The Licensee
shall not change the latch and the lock on the main entrance door or the other doors of the said flat.
10. The Licensors shall be entitled to enter the said flat during the License period with prior intimation
to the Licensee, at all reasonable hours of the day and inspect the said flat.
11. Without prejudice to the foregoing provisions and without prejudice to all or any rights and
remedies that may me be available to the Licensors under this agreement, the Licensee agrees that
the Licensors shall be entitled to recover possession of the said flat and avail the rights conferred by
section 24 of the Maharashtra Rent Control Act, 1989.
