Know what you're getting into. You may think it's possible to file for personal bankruptcy on your own if you cannot afford to hire a lawyer. If you do, remember to educate yourself on things that you should know. Those who do their own bankruptcies often make mistakes that interfere with their ability to secure a discharge. bankruptcy chapter 7 - and triple-check your filings so this doesn't happen to you.
When filing hertz bankruptcy filing, your budget will be a key element. Therefore, you will want to make sure you have a full understanding of any and all fees your lawyer will be charging. Generally speaking, a bankruptcy lawyer charges a sizable fee for his or her services. You will be responsible for paying for the actual bankruptcy, which varies depending on what type you file for. Chapter 7 bankruptcy runs around $300. Then, your lawyer will charge approximately $1000 to $2000. If the fee is too high, you will want to consider another lawyer. But keep in mind that legal services are going to cost something, and it may be to your advantage to pay a bit more for an excellent lawyer, rather than paying much less for a bankruptcy lawyer with far less experience.
I also hate to have to clean up a mess made by another lawyer. It is much easier to assist a client and avoid potential problems than it is to repair damage from choosing the wrong lawyer. I have seen poorly drafted prenuptial agreements and separation agreements. I have had to step in to repair and finish a botched annulment. I have had to step in to repair and finish a botched divorce.
Think of your business lawyer as your part-time VP legal. Some business lawyers are open to retainer arrangements where they will agree to act as your part-time VP legal at a lower cost than hiring a law firm. A lawyer could for instance offer to work a certain numbers of days per month for you at a fixed fee. It could save you money and help you grow your business with a smart person on the inside who gets to understand your business inside out.
Does the lawyer have support staff to handle any questions or issues if your lawyer is busy? Does he have partners? Is he a solo practitioner, or is this a large law firm? Is the lawyer you meet with the one who will be with you every step of the way? Or will your case be assigned to different lawyers as it makes its' way through the legal system?
They have passed all necessary checks. You can always look on the State Bar's web page to see if the lawyer you are considering hiring has ever been publicly disciplined by the Bar, or if they have ever been the subject of any ethical or disciplinary action. If so, ask them to explain - if you are uncomfortable doing this, you're far better off using someone else. Erring on the side of caution is always best in this type of scenario.
Question the lawyer's experience in their field of court representation. Just because a lawyer is a lawyer doesn't mean that he/she will be an effective means of protecting your livelihood in court. Divorce court can get very rough in terms of questions asked and the context of the conversations. If you choose a lawyer who can't represent you well in court, you take the chance of losing any chance at what would otherwise be rightfully yours.
Keep in mind that while many attorneys are willing to consider options when it comes to payment, don't expect every attorney to offer every option listed here. Some only have one payment method. Discuss your choices with your potential attorney, and I wish you the best with your case.
In addition, friends and family are often in the closest position to see that your need to file bankruptcy isn't because of frivolous spending. It's because of a medical emergency, or getting laid off a job, or a divorce. If you rang up your debt buying designer handbags, you might not get much sympathy from those around you. But, if, like most people, some unexpected catastrophe entered your life, your family and friends are often your biggest supporters. Especially when they know the money is going to actually fix the situation instead of just put a band-aid on it. While your family may pay for your bankruptcy with their own credit cards, be sure to read the note below.
