How Does Disclosure Expungement Services Work?
Disclosure Expungement refers to a process in which the records of an individual's criminal convictions and/or arrest for a crime are expunged from their records after serving the applicable jail time. This can have a number of beneficial consequences for an individual who has been convicted of a crime, including lowering their risk of being arrested again by employers, avoiding further charges from criminal activity, reducing their overall sentence, and most importantly, their chance of obtaining a job in the future. Many lawyers specialize in assisting people who are in need of expungement and are available all across the United States.

As most attorneys will tell you, one of the main purposes of expungement is to protect your assets, as well as ones that you may no longer desire. Therefore, it is often sought by people who have been exposed as a victim of crime and/or have been the subject of arbitration forum cases or criminal trial exhibits. Moreover, disclosure expungement can also be sought by people who were exposed to inaccurate and misleading information in the past, thereby causing them harm. Some other common examples of individuals who may seek expungement include former bankers and current bankers, attorneys and law school examiners who have accidentally gotten themselves thrown out of the exam, insurance investigators and claims adjusters who accidentally found fraud within the insurance policy, and government employees who inadvertently disclosed classified information to the public.


As previously mentioned, disclosure expungement can be sought by anyone with a past criminal history. This includes both those who are currently serving time in jail and those who have been released from prison. However, even the most benign actions such as working with a personal injury attorney can be the basis of a disclosure expungement request. The mere act of helping an injured person who is in need of monetary assistance can be the basis for a disclosure expungement request.

However, there are some instances when disclosure expungement must be pursued through court intervention. In cases involving fraud or other criminal acts, it may be necessary for the government to file its own motion to suppress the defendant's statements under the law. In order for this to occur, the government must convince a judge that the statements were made with "reckless disregard" of what would later become a "cry for help". As such, it can be a long and difficult process.

Another situation where disclosure may be required to obtain legal assistance involves efforts to comply with anti-spamming laws. As such, many consulting firms will require potential clients to disclose their history and any prior violations before they are provided with the services of the company and/or individual consultant. Failure to disclose prior violations, at the very least, can result in the referral of the client to another anti-spamming agency. Discosure expungement may ultimately be recommended in cases of potential spamming. Again, this is a process that should be pursued through legal advice.

Disclosures are frequently an integral part of hiring decisions for both private and public sector employees. Even a job applicant may be asked to disclose any previous financial ties to a former employer. While many companies view these as "veritable disclosure" efforts, those employed by consulting firms often view the opposite. Rather than receiving a job offer, the employee receives a disclosure notice. Regardless of the reasons for seeking employment separation, it is always advisable for individuals and families to consult with a highly skilled employment separation attorney to determine whether or not a disclosure may be required.
