Discharge: What happens when you enter into a contract. There are events that discharge you from the contract
CD: There are several types of situations that can cd someone from a contract
DFOC. (I will sell you my bike if it rains tomorrow) Seller doesn't have obligation if it doesn't rain
8a -> In the event of a default, Rob would get liquidated damages. After she signed the contract, she was required to apply for a loan within 7 days and apply for a loan for $180,000. Here, she did so in good faith. Since the bank didn't accept her loan, she can get back her deposit. (This is a condition precedent. Obligated under the contract to apply for a loan in good faith, which she did. Didn't do anything wrong, not in breach) Rob is not able to keep back the payment.
8b -> Nancy cannot get her money. Nancy had an obligation to apply for the loan in 7 days. The contract was dated on May 1, we are right now in July 1. If you breach the condition, you have breached the contract. She cannot get her money back.
9 -> Judgment for Dacor. High tech's obligation was to guarantee personal satisfaction. Dacor can decide if he doesn't like it if high tech did the best possible job. High tech knew this when entering the contract. High tech will not be successful. To protect yourself, you might say what is a normal commercial reasonable work.

Once you perform an agreement, are you discharged from doing it again? -> No.
If you've done the work, you've the obligation for doing the work once.
At a certain point in time, the obligation is discharged (mechanic stalling fixing car)

12 -> Real estate, "Time of the essence". Not a requirement. If put in contract, date of closing is firm. If either party is not able to close the transaction on the date that the time of the essence relates, there's a breach by the party that is unable to the transaction. Requires both parties to finish the contract by the time it was stated. If either party is unable to do so, they are in breach. If their in breach, the other party is discharged of continuing their obligation
a) -> Unless time of the essence is in the contract, pushing back the closing date doesn't change anything
b) -> Belle can force the closing at that point, as she has the money
c) -> Nissan can keep the money as there was a breach. When liquidated dam happen, whatever happens after that transaction, whatever damages there are liquidated from the sum
d) -> (12) She is entitled to down payment. Requires both parties to finish the contract by the time it was stated. If either party is unable to do so, they are in breach. If their in breach, the other party is discharged of continuing their obligation.

AR: if you have a contract with somebody work, and the person says i'm not in doing this under any circumstances. Don't have to wait until breach occurs

Discharge by agreement:
You can always mutually rescind the contract
Replacing a prior agreement
New consideration is in lieu of consideration
Novation: Putting a new person with promisor and promisee

OL:
If something becomes illegal, you wouldn't have an obligation to do transaction

11 ->
a -> Peters is not able to provide a concert hall. Peters did not do anything to cause this. It is impossible for him to provide Selena with a concert hall. If there's an impossibility, Peters is discharged.
b -> Thomas can't get something for nothing. Thomas has to return the rental fee.
c -> Business interpretation protects him from loss of profits in the event of a fire like this.
