WHS legislation and regulations are complex, thick and considerable. Understanding them is a professional's domain, and so is templating their application. That's why we're here. That doesn't mean it's simple to play the game at the task, service or employee level. Today, in the very first of a three-part series, we'll focus on principles, practices and some memory cues that you can utilize. 1|How to Not be Hit for Six|Do Not Make a Bad Situation Worse.
On the cricket pitch, there is no place to conceal, and it can become an extremely lonesome location. In our first example of a WHS legislation breach, a casual truck chauffeur was struck and killed by a forklift (the details are shown as endnotes in case you wish to look more).
The ambulance was then wrongly notified about what happened, and the man's daughter was informed the accident happened due to her dad's neglect. When the Workplace Health and Safety Queensland (WHSQ) investigation took place, they lied again, consisting of the identity of the forklift driver. While the accident was horrible and highly preventable, the action was deemed criminal.
In the courtroom, a minimum of, the directors pleaded guilty to the charges. The court found the moral culpability and the gravity of the offence was substantial. There were issues in regards to the accident itself and the behaviours that occurred afterwards.
They were fined $3 million, and the two directors were convicted and sentenced to 10 months jail time (which was later minimized due to mitigating factors).
What we can state, is that they were faced with a crisis and they acted irresponsibly. They got it for six!

Do Your Incident Procedures Comply with the Legislation?
The WHS legislation does not specifically information HOW incident responses are to be prepared. It does, however, put the obligation squarely on you. If it occurs, we can assist you prepare for the worst and react to a crisis. There are 3 resources worth thinking about.

The reporting form prompts you to ensure all necessary details are reported, many of which can be otherwise missed out on, such as person( s) included, witnesses, any damage, injuries and treatment.

2|Playing Your Wicket|WHS Legislation in Your Workplace.
In cricket, the pitch is one of those truths you have to work with - whatever state it is in. What are the truths of your service wicket?

Like the pitch, WHS legislation is unforgiving. Inspectors may enable some modification for specific scenarios, and prosecutors may even have some grace for you based on efforts or previous events, but God help you if you don't make a good attempt.
They have this suspicious title since they didn't deal with the accident correctly, and they didn't deal with their workplace situation in the time leading up to the accident. They didn't play the pitch they had.
The court discovered:.
- There were no safety systems in place,.
- The directors understood that there were significant risks,.
- Little attempt was made to evaluate or manage the situations, and.
- Adjustments and therapeutic steps were readily available.
These were extraordinary or not brief lapses, and a male is dead now as a result.

- Who: Brisbane Auto Recycling Pty Ltd.
- Where and when: Queensland, May 2019.
- Event: A casual truck driver was struck and killed by a forklift.
- WHS Legislative Charges: Industrial Manslaughter, section 34C, Work Health and Safety Act 2011 (Qld); AND a category 1 offence, section 31, Work Health and Safety Act 2011 (Qld) for failing to comply with their responsibility, as an officer of the Company, under s 27 to ensure that the Company complied with its work health and safety duty under s 19( 1 ).
- Consequence( s): The death of Mr Barry James Willis. The Company was founded guilty and fined $3 million. Directors Hussaini and Karimi were sentenced to 10 months imprisonment.
