HOUSE RENT AGREEMENT

This House Rent Agreement (this “Agreement”) is made this __________, 2021 by and between:

Landlord: Mrs. Anita Das (“Landlord”) AND

Tenant(s): _________________________________________________________ (“Tenant”).

Each Landlord and Tenant may be referred to individually as a “Party” and collectively as the “Parties.”

1. Premises. The premises leased is a/an apartment with:
(a) _____ bedroom(s)
(b) _____ bathroom(s)
(c) _____ common area

located at Patrapada, City of Bhubaneswar, State of Odisha. (the “Premises”).

2. Agreement to Lease. Landlord agrees to lease to Tenant and Tenant agrees to lease from Landlord, according to the terms and conditions set forth herein, the Premises.

3. Term. This Agreement shall be considered a:

Fixed Lease. This Agreement will be for a term beginning on 1st April 2021 and ending on 31st March, 2022 (the “Term”). At the end of the Term:

A month-to-month holdover tenancy will be created. If Landlord accepts a rent payment from Tenant, other than past due rent or additional rent, after the Term expires, both parties understand that a month-to-month holdover tenancy will be created at the agreed upon monthly rent, unless proper notice has been served as required by applicable laws. If either Tenant or Landlord wishes to end the month-to-month tenancy, such Party must provide thirty (30) days’ written notice before the desired termination date.

The Tenant must vacate the Premises. Unless this Agreement has been extended by mutual written agreement of the Parties, there will be no holding over past the Term under the terms of this Agreement under any circumstances. If it becomes necessary to commence legal action to remove Tenant from the Premises, the prevailing Party will be entitled to attorney’s fees and costs in addition to damages.

4. Rent. Tenant will pay Landlord a monthly rent of __________. Rent will be payable due on the last day of each month. Rent will be paid to Landlord by the following method: Bank Transfer and will be payable in Rupees.

Proration:
Rent for any period during the Term which is for less than one month will be a pro rata portion of the monthly installment.

5. Late Fee. A late fee will be charged if rent is not paid on time. Tenant agrees to pay a set late charge of 5% of the rental amount.

6. Utilities. Tenant is responsible for payment of all utility and other services for the Premises.

7. Security Deposit. Upon signing this Agreement, Tenant will pay an amount equivalent to two months of rent as security deposit to Landlord. The security deposit will be retained by Landlord as security for Tenant’s performance of its obligations under this Agreement. Any damage happening to the property during the stay of the tenant and the repair there off will be adjusted against the said advance (security deposit).

8. Use of Premises. The Premises will be occupied only by Tenant and Tenant’s immediate family and used only for residential purposes. Tenant will not engage in any objectionable conduct, including behavior which will make the Premises less fit to live in, will cause dangerous, hazardous or unsanitary conditions or will interfere with the rights of others to enjoy their property. Tenant will be liable for any damage occurring to the Premises and any damage to or loss of the contents thereof which is done by Tenant or Tenant’s guests or invitees.

10. Maintenance and Repairs. Tenant will maintain the Premises, including appliances in clean, sanitary and good condition and repair. Tenant will not remove Landlord’s appliances from the Premises for any purpose. If repairs other than general maintenance are required, Tenant will notify Landlord for such repairs. In the event of default by Tenant, Tenant will reimburse Landlord for the cost of any repairs or replacement.

11. Rules and Regulations. There are separate rules and regulations governing the Premises. Landlord has prescribed the rules and regulations governing Tenant’s use and enjoyment of the Premises, attached hereto as Exhibit A, and incorporated by reference herein. Tenant acknowledges receipt of and agrees to adhere to such regulations.

12. Alterations. Tenant will not make any alteration, addition or improvement to the Premises without first obtaining Landlord’s written consent. Any and all alterations, additions or improvements to the Premises are without payment to Tenant and will become Landlord’s property immediately on completion and remain on the Premises, unless Landlord requests or permits removal, in which case Tenant will return that part of the Premises to the same condition as existed prior to the alteration, addition or improvement.

13. Smoking and Drinking. Smoking and drinking alcoholic beverages of any kind is strictly prohibited on any part of the Premises. This prohibition applies to Tenant and any visitor, guest or other occupant on the Premises.

14. Pets. Tenant is NOT allowed to have or keep any pets, even temporarily, on any part of the Premises.

IN WITNESS WHEREOF, the Parties hereto, individually or by their duly authorized representatives, have executed this Agreement as of the Effective Date.

Exhibit A

RULES AND REGULATIONS

Tenant shall abide by the following rules and regulations while occupying the Premises:
1. Tenant will not obstruct the driveways, sidewalks, courts, entry ways, stairs and/or halls.

2. Tenant will keep all windows, glass, window coverings, doors, locks and hardware in good, clean order and repair.

3. Tenant will not leave windows or doors in an open position during any inclement weather.

4. Tenant will not hang any laundry, clothing, sheets, etc. from any window, rail, porch or balcony nor air or dry any of same within any yard area or space.

5. Tenant will not cause or permit any hooks to be placed upon any door or window without the prior written consent of Landlord.

6. Tenant will keep all bathrooms, sinks, toilets, and other water and plumbing supplies in good order.

7. Tenant will not allow any sweepings, rubbish, sand, rags, ashes or other substances to be thrown or deposited into any sinks or toilets.

8. Tenant's family and guests shall not make or permit any loud or improper noises, or otherwise disturb other residents in the immediate area.

9. Tenants will not drill any hole on the wall, door, window. They will maintain the color and texture of the wall, doors and windows, tiles in proper condition.

10. Tenants will not paste any poster on the wall, doors and windows.

11. Tenant will abide by and be bound by any and all rules and regulations affecting the Premises or the common areas of the Premises which may be adopted or promulgated from time to time by Landlord.
