åI consent to the jurisdiction of Federal District Court for the judicial district in which my address is located in California, and I will accept service of process from the person who provided the DMCA notification or an agent of such person. i will now tell you the full story i will provide evidence that i have, anything else i say i swear is the truth and nothing but the truth, i have known Zachery Tyler Russell (from now on will be known as xxmobkiller), the person who claims owns rights to the plugin (a plugin refer to an addon to a minecraft server administration software known as spigot or bukkit. which allows for you to "mod" the game of minecraft in way that do not require a modded client.) for quite a while now. We started talking about 3 months ago while he was developing a fork of survival games plugin that is not that relvant to the situtation. He also developed a plugin known as "Lobby Essentials or Lobby FunPack" that is where it all beings. He posted a free plugin to http://www.spigotmc.org/ titled Lobby Essentials, it was currently working for the minecraft version 1.7.10 and a protocol hack version of 1.8. version he released would not work on Spigot 1.8. I hired xxmobkiller as my developer to develop custom plugins on my minecraft. he accepted the position and started working for me. xxmobkiller worked under terms (see image 1), in those terms it states that you must work for me for 1 year. He started working for me on January 30, 2015 he ended up quiting without any notice, just vanishing on February 17 2015, i later decided to give him some time before i actually fired him. On February 27, 2015 i decided to fire him due to inactivity. Since he was working for me i had paid him a sum total of 25$ (see image 2). As stated in the TOS he agreed to he would be working for me for 1 year, he did not do that, Also as stated in the Terms Of Service all plugins he make for RagecraftGames give ragecraftgames full rights to the plugins he makes. now back to plugin titled Lobby Essentials. About 1 month after it was posted on spigot for free it was deleted. The reason of deletion are unknown to me but there were rumors that it contained corrupted code in which he can do bad things to your minecraft server. That is all that happened to Lobby Essentials... until he started to work for me he made a new version (meaning it is now under my rights as stated in the in Terms of Service). I then talked to my father about this situation. He said that he made plugins for you and did enough work that the work he did was worth 25$, i agreed that in the time of the developership he did do 25$ so instead of refunding the money i decided just to sell the plugin he made to in order to get back the money i paid him. I edited the version to make it a little more original and cleaned up a little code. So then i added a custom map spend about 4 hours creating a sell page and posted it onto http://www.spigotmc.org/ as a resource called "Lobby Essentials Plus". They were denied With the reason "no proof they are yours" i then started a private conversation with the staff members in charge of accepting the plugins. i cleared things just and then they accepted them (see image 3). xxmobkiller was not happy and posted some inapproite things on the support for the plugin. The plugin was then removed so that this problem could be solved. me xxmobkiller and the resources manager were then put into a conversation to solve the problem. the resource manger known as Z750 respectfully asked for both sides and some evidence. I submitted my evidence and i then won rights to sell it there for the second time. the full conversation can be found (see image 4). I then posted a updated version using photos from xxmobkillers website. He then saw a moment to strike so he change those photos to child pornography. He seconds after told he about this brillant thing he just did in Skype to where i was able to remove it within seconds. Unfortually i do not have any proof of this other than telling me on skype (see image Skype). Since that time he has just been bothering me on Skype about how he is going to DMCA me. I didn't care because i know that i have the fair and honest rights to this plugin. Below i will provide you with any links of information and references that i have mentioned in this "essay:.
