By participating in the exchange, I confirm that I am the sole and absolute owner and/or user of the product mentioned above (device).

I understand that the following checks will be conducted by the wishmaster who will be delivering the new device and picking up the old device:
1. This offer for mobile exchange (“Offer”) is being run by Seller on www.flipkart.com,
Flipkart Mobile App, Flipkart Lite Platform (all three collectively referred to
as “Platform”). The Platform is owned and operated by Flipkart Internet Private
Limited (“Flipkart”) and is applicable for the purchase of new mobile phones (“New
Device”) in exchange of an old mobile phone (“Old Device”).

2.By participating in the exchange, I confirm that I am the sole and absolute owner
and/or user of the Old Device mentioned above.

3. I understand that checks will be conducted by the delivery executive who will be
delivering the new device and picking up the Old Device.

4. I understand that the Offer is valid for select New Devices only.

5. I understand that the Offer is applicable on select/eligible pin codes only. I
agree to check eligibility of my pin code before placing any order under this
Offer.

6. I understand that the pick-up of Old Device and delivery of New Device will
happen from the same address.

7. Following issues will lead to a reduction in exchange value of the Old Device:
a) On Screen: Cracks, Screen coming out of body, touch-screen issue or discolouration. The
display should not have any spots or dead pixels.
b)On Body: Cracks, Body bent/bulge/de-shaped, parts missing. Battery should not be
swollen and/or damaged.

Value reduction on the basis of condition is only available on select pincodes. For other pincodes these issues
will lead to rejection. Check eligibility on exchange page in “Read all checks”
section where customer is shown the exchange value


8. Following issues will lead to rejection of exchange of the Old Device:
a) Phone does not switch on.
b) Brand/model
of the Old Device is different from what is mentioned provided by me on the
Flipkart Website at the time of purchase of the new device.
c) Screen lock (all forms of screen lock viz; pattern, pin, password, fingerprint, face
recognition, smart lock, etc. needs to be deactivated) or iCloud lock (Apple
phones) is not removed.
d) IMEI,on dialing *#06#, does not match with information provided by me in the Flipkart
website at the time of purchase of the New Device
e) Mobile phones are counterfeit/fake

9.Depending on the condition of Old Device, the
exchange value can reduce. The value drop is pre-decided by Flipkart. Customers
can find the value drop vs condition chart in “View checks” page in “My orders”
section of mobile bought.

10. In case of drop in exchange value, customer can pay the difference amount.
RAM & ROM of your phone will be checked by delivery executive. If phone has higher variant, you may get higher
discount at the sole discretion of Flipkart. Additional money, if any, will be
credit to your Flipkart wallet.

11. In case customer does not like the exchange value offered, he/she can choose to not
give the exchange phone to Flipkart and pay difference amount to get the New Device.

12. If your Old Device does not qualify for pick up, you can still get your New Device by
paying an additional amount (equivalent to the discount that you got for your
exchange item) in cash at the time of delivery of your New Device. Bank
discounts that you might have got on your order will not be re-calculated in
this case.

13. I understand that in the event the Old Device is not working or the delivery
executive is not able to do an iCloud unlock check or screen lock check / IMEI
check due to a phone being 'factory reset or if there is any mismatch in the
information provided by me regarding the old Device, then the exchange offer
will be cancelled and the delivery executive will neither hand over the New
Device to me nor take the Old Device. Any amount paid at the time of purchase
of the New Device will be refunded as per the refund policy of Flipkart, subject to deduction of pickup charges as provided below.


14. I understand that, if at doorstep I reject the exchange offer, there is no option to a re-attempt the
exchange of my phone in the same order. I will either need to place a new order
without exchange or use a different mobile for exchange.

15. I confirm that Old Device which I am exchanging under the exchange/ buy back
program is genuine and is not counterfeit, free from any and all encumbrances,
liens, attachments, disputes, legal flaws, exchange or any agreement of sale
etc. and I have got the clear ownership of the said Old Device.

16. No accessories (earphones, charger etc.) will be collected at the time of
collecting the Old Device.

17. No documents (bills, warranty card etc.) of Old Device will be collected during
collection of the Old Device.

18. The final price will be inclusive of all discounts and other offers available on
the product exchange program.

19. I understand that the Old Device is being bought by the Seller from
whom I am purchasing the New Device solely in exchange for the purchase of the New
Device from the Seller. There is no other consideration due from the Seller or
Flipkart to me for availing the Offer/exchange program.

20. I understand that for Old Devices which are Windows, iOS devices and previous
versions of Android, or, where the exchange program is being availed from the
Flipkart.com Website or Flipkart Mobile Website, I will receive a flat rate as
the value of the old Device depending on the brand, model and the result of the
check conducted by the wishmaster. I understand that the wishmaster’s decision
with regard to the quality check above shall be final.

21. I agree to indemnify and keep indemnifying Flipkart, the Seller and any future buyer of
the Old Device against all or any third-party claims, demands, costs, expenses
including attorney fees which may be suffered, incurred, undergone or sustained
by Flipkart, its affiliates, the Seller or any future buyer due to usage of the
Old Device by me till date.

22. I understand that Offer applicable is being run by the Seller and not by Flipkart
therefore, Seller alone shall be responsible for fulfilling the terms of this
Offer and Flipkart shall not be liable for any damages loss, injury or any
other liability arising to the customers as a result of the Seller’s failure to
honour its obligations with respect to the Offer. Any claims made by the
customer owing to any act or omission by the Seller with regard to the Offer
shall be the sole liability of the Seller and Flipkart shall not be liable in this
regard.

23. I confirm that all the data in the said Old Device will be erased by me before
handing it over under the exchange program. I also confirm that in spite of
erasing the data manually/electronically, if any data is still accessible due
any technical reason, Flipkart or the Seller shall not be responsible for the
same and I will not approach Flipkart.com or the Seller for any retrieval of
the data.

24. I hereby give my consent that my personal information that I have provided in
connection with this exchange program might be processed, transferred and
retained by the Seller and other entities involved in managing the program for
the purposes of validating the information that I provided herein and for the
administration of the program.

25. I understand once the Old Device is sent by me to Flipkart, in no scenario will
this device be returned back to me.

26. I understand that different yields will be provided for different devices.

27. I understand that the New Device delivery and the old Device pickup will happen
simultaneously (hand in hand) and I shall keep the Old Device ready to be given
for exchange.

28. In relation to shipping charges of Old Device I understand that I will have to pay
pickup charges towards shipping charges of Old Device as mentioned in the
checkout page. The pickup charges will be over and above the exchange value of
the Old Device. I understand and agree that in the event that the exchange
offer is cancelled as a result of the Old Device failing any of the checks for
the product exchange program mentioned in this Terms and Conditions - the
refund of any payment made will be after deducting the pickup charges.
