La Convención de los Derechos del Niño (CDN) de las Naciones Unidas de 1989 –ratificada por nuestro país mediante la ley 23.849, sancionada en setiembre 27 de 1990; promulgada de hecho en octubre 16 de 1990)– tiene actualmente jerarquía constitucional desde que en el año 1994 fue incorporada a nuestra Constitución Nacional (CN) a través del artículo 75 inciso 22.
La CDN postula una nueva forma de ver al niño: un sujeto que necesita y que adquiere progresivamente un mayor grado de autonomía y con ella, de derechos, es decir, como un ciudadano, y no ya (como era tradicional) un individuo dependiente de los adultos e “incapaz” frente al derecho.
La Convención sobre los Derechos del Niño (CDN) es el tratado internacional de la Asamblea General de Naciones Unidas que reconoce los derechos humanos básicos de los niños, niñas y adolescentes.
Los cuatro principios fundamentales de la Convención son:
La no discriminación
El interés superior del niño
El derecho a la vida, la supervivencia y de desarrollo
La participación infantil.
