Madam,

Re: your housing loan with the branch bearing no.36770600000393

We have received a letter dated 07.12.2018 from Mr. gurwinder Singh your son and POA holder requesting therein to release the title deed property (house) mortgaged by you to security house loan facility sanctioned to you .
As you are aware that your captioned housing loan degraded to NPA category due to non deposit of installment and interest by you regularly as per terms and conditions of sanction. subsequently, bank has initiated action under the provisions of SARFAESI act to enforce the security charged to bank to recover banks dues.
Mr.gurwinder Singh visited us along with some persons claiming to be your representatives.we have suggested him the possible means to adjust the account in full and final but he failed to deposit the required amount to adjust the said account.
Now he has submitted a copy of POA issued by you in his favour and he is claiming to be the last and undisputed POA folder and has requested us to handover the title deed of the property to him after adjusting the loan account on the pretext that you are not available in India to receive the title deed.he has informed that you are residing overseas and not in position to visit India for the said purpose.
In view of the above, we request you to inform the following:
a) That the above POA has been issued by you and the same is enforceable and not cancelled by you.
b) Submit authority letter duly countersigned by the embassy of the concerned country along with certified copy of your passport and Visa, clearly authorised the bank to release the property to Mr gurwinder Singh, your son and being POA holder.
c) Undertaking that all the charges for verification of your authority letter will be Borne by you.
As required details of charges debited in your account is given below:
- publication charges (SARFAESI notice) : Rs.10,949/-
- Advocate fee(for SA in DRT) : Rs.4,01,500/-
- Advocate fee ( for MA in high Court) : Rs .49,000/-
- enforcement agency charges : Rs.50178/-
We again request you to arrange to deposit all the dues at the earliest to avoid auction of the property under the provisions of sarfaesi act. the details of contractual dues have already been provided to you.
We reiterate that while issuing authority letter it should be specifically mentioned that Mr gurvinder Singh is authorised to receive the title deed/ sale deed of the property from the bank on your behalf.
