NOTICE OF TRUSTEE'S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated June 18, 2003, and the Deed of Trust of even date securing the same, recorded June 27, 2003, as Instrument No. 03126698 and modified on July 19, 2005, as Instrument No. 05112585 in Office of the Register of Deeds for Shelby County, Tennessee, executed by William D. Flowers and Norma H. Flowers, conveying certain property therein described to Accurate Titile & Escrow, Inc. as Trustee for Mortgage Electronics Registration systems, Inc., as nominee for Novastar Mortgage Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on June 27, 2014 on or about 12:00 P.M., at the Shelby County Courthouse, Memphis, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Shelby County, Tennessee, and being more particularly described as follows:
Lot 9, Final Plat, Westmeade Planned Developement, as shown on plat of record in plat Book 202 Page 58, in the Register''s Office of Shelby County, Tennessee, to which plat reference is hereby made for a more particular description of said property.
Less and Except: Part of Lot 9, Westmeade P.D. as shown on plat of record in Plat Book 202, Page 58, in the Register''s Office of Shelby County, Tennessee and being more particularly described as follows:
Commencing at a chisel mark found in the Southeasterly right of way line of Flowers Oak Cove (31.00 feet ROW), a distance of 635.76 feet Southwardly, as measured along said Easterly right of way line from it''s tangent intersection with the Southerly right of way line of Poplar Pike (80.00 feet ROW), said point being in the Northeasterly corner of Lot 9;
Thence on a bearing of South 17 degrees 29 minutes 15 seconds East along the Easterly line of Lot 9, a distance of 130.14 feet to an iron pin set in the Easterly line of Lot 9, said point being the true point of beginning;
Thence on a bearing of South 17 degrees 29 minutes 15 seconds East along the original property line of Lots 8 and 9, distance of 63.53 feet to an iron pin found in the Northerly line of the Loran M. and Sonya E Snow Tract (L-3-5213);
Thence on a bearing of North 86 degrees 00 minutes 19 seconds West along the Northerly line of said Loran M. and Sonya E. Snow, tract, a distance of 45.77 feet to an iron pin set;
Thence on a bearing of North 16 degrees 55 minutes 32 seconds West, a distance of 48.71 feet to an iron pin set;
Thence on a bearing of North 48 degrees 54 minutes 42 seconds East a distance of 16.44 feet to the point of beginning.
Less and Except: Part of Lot 9, Westmeade P.D. as shown on plat of record in Plat Book 202, Page 58 in the Register''s Office of Shelby County, Tennessee and being more particularly described as follows: Commencing at a chisel mark found in the westerly right of way line of Flowers Oak Cove (31 feet ROW) a distance of 559.49 feet southwardly, as measured along said westerly right of way line, from it''s tangent intersection with the Southerly right of way line of Poplar Pike, said point being the Southeasterly corner of Lot 11; thence Southwardly along a curve to the left having a radius of 45.50 feet and an arc length of 50.80 feet to a Chisel Mark found at the Northeasterly corner of Lot 9; thence South 64 degrees 7 minutes 35 seconds West along the Northerly line of Lot 9, a distance of 86.81 feet to an iron pin set, said point being the true point of beginning, thence South 14 degrees 44 minutes 18 seconds West, a distance of 19.21 feet to an iron pin set. Thence South 72 degrees 57 minutes 51 seconds West, a distance of 94.92 feet to an iron pin found in the Westerly boundary line of Westmeade P.D.; thence North 64 degrees 7 minutes 35 seconds East, a distance of 106.30 feet to the point of beginning containing 775.09 square feet.
