PRELIMINARY



By participating in this Meet and Greet Offer (“Offer”), the user (“You” or “Your”) agrees to be bound by:
these terms and conditions (“T&C”); and
the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on www.flipkart.com (“Website”), Flipkart Mobile App, Flipkart Lite Platform (all three collectively “Platform”), which are owned and operated by Flipkart Internet Private Limited (“Flipkart”, “We” or “Our”). The Contest is being organized by Colgate-Palmolive (India) Limited ( “Colgate”)


OFFER DETAILS



The Offer will commence from__22nd August, 2018__________ to ______31st August, 2018_____ (“Offer Period”).
“Colgate Meet Ranveer Singh Contest” (“Contest”) is valid across all Platforms operated by Flipkart Super Mart across all their locations in India except for Tamil Nadu.
To participate in the Offer You must do/ fulfill the following:
Age must be 18 years or above;
This Contest is organized by the Colgate only for Flipkart Super Mart Customer.
Must have a valid account on the Platform and log into the same;
To participate a Member needs to buy any pack of Colgate MaxFresh pack from Flipkart Super Mart during the Offer Period. Participation to this contest is purely voluntary.
1(One) lucky winner for the Meet & Greet, across all the Flipkart Super Mart Platform declared vide the aforesaid lucky draw, will get a chance to travel to Mumbai for an event featuring actor Ranveer Singh.
Each Flipkart Super Mart membership Id is eligible for only one entry, no multiple entries of the same membership ID are allowed under this contest.
The winners will be declared on 10th September, 2018 on Flipkart Grocery Homepage______ at https://www.flipkart.com/fk-supermart-store?marketplace=GROCERY____ and via email to their registered email ID informing them of the same. You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Colgate/Flipkart shall not be responsible in any manner.
For Meet & Greet winners whose primary registered address with Flipkart Super Mart (for the delivery of the Colgate MaxFresh during the Term) is outside the radius of 300 km from Mumbai GPO, Colgate will bear the fare of economy class air travel from the nearest available airport of the winner’s registered address with Flipkart Super Mart to Mumbai for the event, including return economy class air fare and a stay in Mumbai for such number of day(s) and type/ category of hotel as may be decided by Colgate. For Meet & Greet winners, whose registered address with Flipkart Super Mart is within a radius of 300 km from Mumbai GPO, Colgate will bear the fare of 3 tier AC train travel from the nearest available railway station of the winner’s registered address with Flipkart Super Mart with train service to Mumbai for the event, including return 3 tier AC tickets and a stay in Mumbai for such number of day(s) and type/ category of hotel as may be decided by Colgate. Transit to/from airport/railway station, food and all other incidentals will need to be borne by the winners and shall not be reimbursed. Winners from Mumbai will not be provided travel and hotel accommodation.


The customers who cancel/return their orders placed during the Offer Period will no longer be eligible for the Offer.
For the purpose of declaring the winners of this Contest, a lucky draw will be conducted by Colgate basis purchase of Colgate MaxFresh from the Platform made during the Term. Inability to intimate any Participant about the date of lucky draw shall not make Flipkart Super Mart / Colgate responsible or liable in any manner whatsoever.
The date scheduled for attending the event featuring Ranveer Singh, may be altered depending on his availability. The meet and greet with Ranveer Singh is subject to his availability.
Colgate explicitly disclaims any misinterpretation of the contest entitlements to meet for an, in person, one to one meeting with the actor Mr. Ranveer Singh. The Contest only allows a chance to the winners to travel to Mumbai for an event featuring Ranveer Singh.
Details of travel and the event for the Meet & Greet winners will be communicated to winners separately by Colgate representative. Failure of the Meet & Greet winner to travel during the scheduled travel date and time shall constitute winner’s forfeiting of the entitlements of the Contest and Colgate reserves its right to allow any other winner, which may be selected by lucky draw on a random sampling basis from amongst the participants, if feasible. A winner cannot assign his/her entitlements to any other person under this Contest transferable and the winners shall be required to carry their photo identification card to the venue. Colgate and Flipkart Super Mart shall not be responsible for any loss, damage, injury (personal, property or both) or any other liability arising out of the Contest to the Participants / winners. All winners will be responsible for their own safety, insurance and other arrangements during transit and at the event.
Participation into this Contest confirms acceptance of these terms and conditions and shall constitute irrevocable permission given by the winner to Flipkart Super Mart/ Colgate to use the winner’s name, photographs, videos, audio, if any, for the limited purpose of displaying the results, marketing, publicity / advertising in such manner as may be deemed fit by Flipkart Super Mart/ Colgate viz. in print, TV, social media etc, without any monetary compensation payable to any winner and without any restriction to its frequency and use.
The Offer mentioned above is non-transferable and the winners shall be required to carry their photo identification card to the venue and shall not be allowed to enter the venue if they fail to do so. The winner cannot claim cash in lieu of the gift.
Only the winner shall be eligible for the event, and he/she cannot be accompanied by anyone.



GENERAL TERMS AND CONDITIONS





This Offer is valid only in India.
The Offer is open to only end consumers and not the resellers of the Products.
Prizes shall not be settled with cash in lieu by Flipkart and are not transferable.
Colgate’s decision with regards to declaration of winner and forfeiture of Prize will be final and binding and no inquiry in this regards will be entertained. Colgate reserves the right to amend, modify, discontinue or extend this Contest.
The Contest is subject to cancellation / modification or there may be change of event schedule or location etc, at the sole discretion of Colgate. This Promotion is run by Colgate and terms and conditions of Colgate will be binding on the Participant and winner(s).
Participants are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
Colgate, in its sole discretion, reserves the right to disqualify You from the benefits of this Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer.
Members and families of Colgate / Flipkart Super Mart staff and management will not be eligible for this Contest.
The Offer shall be subject to force majeure events and on occurrence of such an event, the Offer may be withdrawn at the discretion of Flipkart.
Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Offer.
Flipkart will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by sellers on the Platform and the same shall be at the sole risk and consequences of the sellers.
Flipkart does not endorse the products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products, which shall be at the sole liability and responsibility of the sellers.
You hereby agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Flipkart as a consequence of (i) violation of terms of this T&C by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
This T&C shall be governed in accordance with the applicable laws in India. Courts at Mumbai/Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
You hereby agree to bear all government taxes, levies and duties.
You confirm that no claims in respect of damages or consequential loss or delays if any shall be claimed by You against Flipkart in respect of this Offer.
The Offer shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
